Recently, I came by a Forbes article concerning the distribution and sale of wine both in and out of state. The article peaked my interest because the case at hand has striking resemblance to a wine related case that we looked at in class. Byrd vs. Tennessee Wine... is a Dormant Commerce Clause issue. In the case an out of state wine retailer was denied a retail license in Tennessee because they did not meet the two-year residency requirement. The company believes this is unconstitutional because it discriminates against out of state retailers. The case was recently granted cert from the Supreme Court. The following document outlines the case and decision made in District Court by Judge Sharp. I find it interesting that this case has even made it to the Supreme Court considering there has been similar past cases that should serve as the precedent for this case.
